Terms of Service

These Terms of Service (the "Terms") are an agreement between you and PikSheet.com LLC("PikSheet," "we," "us"), and they govern your access to and use of the PikSheet websites and mobile apps (the "Service"). By creating an account, joining a pool, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Section 18 requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days. Please read it.

1. What PikSheet is

PikSheet is sports pool management and scoring software. Commissioners can create pools, invite members, collect picks, grade results, track standings, and record pool activity. PikSheet provides the software and the platform services around it. PikSheet does not sponsor pools, set or fund pool prizes, collect pool entry fees, hold or escrow member money, accept bets, or pay pool winnings.

2. Not a gambling or wagering service

PikSheet is not a gambling, wagering, sports betting, daily fantasy sports, or gaming service, and it is not a party to any wager, contest, or prize arrangement between users. PikSheet never receives, holds, transmits, or distributes stakes, entry fees, or prizes. Any money arrangement connected to a pool exists solely between the commissioner and the participants in that pool, is made and settled entirely outside the Service, and is their responsibility alone.

Because PikSheet does not collect entry fees or pay winnings, we do not maintain a list of restricted states. You, and the commissioner of any pool you join, are responsible for determining whether that pool is lawful where each participant is located and for complying with any law that applies to it. You may not use the Service to conduct, facilitate, promote, or settle unlawful gambling.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, whichever is greater, to use the Service. The Service is intended for users in the United States. You are responsible for making sure your use of PikSheet, and any pool you create or join, complies with all laws, rules, and workplace, school, league, or platform policies that apply to you.

4. Your account

You are responsible for your account credentials and for all activity under your account. Provide accurate account information and keep it current. You may not share your account, let someone else use it, or create an account for another person without their authorization. Notify us at support@piksheet.com if you believe your account has been compromised.

5. Commissioners and pool members

Commissioners have full control over their own pools, including pool settings, membership, entry rules, deadlines, tiebreakers, scoring options, payment records, and every other administration choice. Pool members are responsible for reviewing the rules of each pool they join and for raising any concern about a pool directly with that pool's commissioner.

PikSheet may enforce product-level limits, billing locks, security controls, or abuse prevention measures across the Service, but PikSheet is not a party to your pool and is not responsible for resolving private disputes between commissioners and members, including disputes about rules, results, standings, eligibility, payment, or prizes.

6. Platform fees, and money PikSheet does not touch

PikSheet may charge a platform fee for creating or operating a pool. Platform fees are the only money PikSheet collects, they are paid to PikSheet by the commissioner through Stripe or another payment provider we designate, and they are payments for software access — not entries, stakes, or contributions to any prize. Except where required by law or stated at the time of purchase, platform fees are non-refundable.

Pool entry fees, buy-ins, reimbursements, prizes, and payouts between commissioners and members are not part of PikSheet's billing and never pass through the Service. PikSheet does not custody, verify, guarantee, or distribute those funds.

Some pool formats let a commissioner record who has paid and how much, and may display dollar amounts. Those figures are bookkeeping entries typed in by the commissioner. They are not payments processed by PikSheet, PikSheet does not verify them, and they do not represent funds held by PikSheet or any obligation of PikSheet to anyone.

7. Acceptable use

• Do not use the Service for unlawful, fraudulent, abusive, or deceptive activity.
• Do not use the Service to conduct or facilitate unlawful gambling.
• Do not attempt to bypass security, billing, eligibility, rate-limit, or access controls.
• Do not scrape, reverse engineer, overload, interfere with, or disrupt the Service.
• Do not impersonate another person or misrepresent your authority over a pool.
• Do not manipulate picks, deadlines, entries, or results, or help anyone else do so.
• Do not submit content that infringes rights, violates privacy, or is abusive or harmful.

8. Your content and pool data

You retain ownership of information you submit to PikSheet. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit that information as needed to operate, secure, support, and improve the Service. We do not sell your content or license it to others for their own purposes.

Pool records may remain available to commissioners, members, or platform admins where needed to preserve standings, audit trails, payment records, or support history, including after you leave a pool or delete your account. If you send us feedback or suggestions, we may use them without restriction or obligation to you.

9. Sports data, scoring, and standings

PikSheet grades picks and derives standings from sports data supplied by third parties. That data may be delayed, incomplete, incorrect, revised, or unavailable, and games may be postponed, rescheduled, suspended, or cancelled. We work to keep scoring accurate, but we do not guarantee that results, grades, or standings will be correct, timely, or uninterrupted.

Standings shown in the Service reflect the sports data available at the time they are calculated. If that underlying data is later corrected or revised, grades and standings may change, including after a week or a pool appears to be complete. PikSheet has no obligation to preserve any earlier state, to notify anyone that a result changed, or to determine the outcome of any pool. Deciding a pool's final result — and deciding what to do when data changes after the fact — is the commissioner's responsibility, not ours.

10. Third-party services

PikSheet relies on third parties for hosting, authentication, payments, push notifications, analytics, monitoring, and sports data. Those services have their own terms and privacy policies, and we are not responsible for them. The Service may link to third-party sites we do not control or endorse.

11. League and team names

PikSheet is an independent product. It is not affiliated with, endorsed by, sponsored by, or approved by the National Football League, any NFL club, any other sports league, or any team, and none of them are responsible for the Service. Team names, league names, logos, and marks shown in the Service belong to their respective owners and are used only to identify the games a pool covers.

12. Service changes and availability

We may change, suspend, or discontinue features, pool formats, integrations, or the Service itself at any time. We work to keep PikSheet available, but we do not guarantee uninterrupted or error-free operation.

13. Termination

You may stop using PikSheet at any time and can delete your account from the app. We may suspend or terminate access if you violate these Terms, create risk for the Service or other users, fail to pay platform fees you owe, or use the Service in a way we reasonably believe is unlawful or harmful. Sections 6 through 11 and 14 through 22 survive termination.

14. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. We do not warrant that the Service will meet your requirements, that scoring or standings will be correct, or that defects will be corrected.

15. Limitation of liability

To the fullest extent permitted by law, PikSheet will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunity, pool disputes, prize disputes, money exchanged between users, or errors in third-party sports data, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid PikSheet in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless PikSheet and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms or of any law, or any pool you create, run, join, or take part in — including any dispute about money, entries, or prizes connected to that pool.

17. Informal resolution

Before starting arbitration, you agree to email support@piksheet.com with a description of your dispute and the relief you want, and to give us 30 days to try to resolve it. Most problems can be sorted out this way.

18. Arbitration, class action waiver, and jury waiver

Please read this section carefully — it affects your rights.

Except as stated below, you and PikSheet agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in the county where you live or by remote hearing, unless you and we agree otherwise.

Class action and jury waiver. You and PikSheet agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding. You and PikSheet each waive any right to a trial by jury.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized access to the Service.

How to opt out. You may opt out of this arbitration section, including the class action and jury waivers, by emailing support@piksheet.com with the subject line "Arbitration Opt-Out" within 30 days after you first accept these Terms. Include the email address on your account. Opting out affects nothing else in these Terms, and we will not close your account or treat you differently for doing it.

If any part of this section is found unenforceable, the rest of this section remains in effect — except that if the class action waiver is found unenforceable as to a particular claim, that claim proceeds in court rather than in arbitration.

19. Governing law and venue

These Terms and any dispute arising from them or the Service are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration under Section 18, you and PikSheet consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.

20. Apple App Store

If you use the PikSheet iOS app, you acknowledge that these Terms are between you and PikSheet only, not with Apple, and that PikSheet alone is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim you have relating to the app, including product liability, legal-compliance, and intellectual property claims. Your use of the app must comply with the Apple Media Services Terms of Use. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

21. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we will give reasonable notice through the Service, by email, or by other appropriate means, and we may ask you to accept the updated Terms before you continue using the Service. If you keep using PikSheet after the updated Terms take effect, you accept them. If you do not agree to the updated Terms, stop using the Service and delete your account.

22. General

These Terms and the Privacy Policy are the entire agreement between you and PikSheet about the Service. If any provision is found unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control. These Terms do not create any third-party beneficiary rights except as stated in Section 20.
